1. Hope Media Group and Overview of Privacy Prerogatives
Hope Media Group (referred to at times below as “Hope Media” or “HMG”) owns and/or operates an array of online platforms, websites, radio stations, and brands that serve to connect people more deeply to God. Hope Media Group is a Texas nonprofit corporation organized and operated as a public charity organization described in Title 26, Section 501(c)(3) of the Internal Revenue Code. Hope Media Group’s stations, brands, and mobile applications include, but are not limited to, KSBJ, Vida Unida, NGEN Radio, HOPE ON DEMAND, Special Events, [between] music, , WayFM, Worship 24/7, Hope Nation, Hope Events, God Listens, WAYLOUD, Way New, Way Back, Gospel 24/7 and all other HMG Platforms that incorporate this Privacy Policy.[DA1] [AT2]
Hope Media Group respects your online privacy and security. This Privacy Policy is designed to provide information and disclosures about how information you may share with HMG, or how your interactions with HMG on any of the HMG Platforms may be used, and this Policy incorporates by reference and is designed to work with HMG’s Terms of Use Policy and Gift Acceptance Policy. 2. HMG Platforms
This Privacy Policy applies to all current and future HMG websites, mobile applications, streaming services, podcasts, donation systems, online stores, event platforms, AI services, and digital properties, including Hope Media Group, KSBJ, WayFM, Vida Unida, NGEN Radio, Worship 24/7, Hope Nation, Hope Events, God Listens, WAYLOUD, Way New, Way Back, Gospel 24/7, HOPE ON DEMAND, Special Events, [between] music, and future HMG properties (collectively referred to herein as the “HMG Platforms”).
3. Acceptance of Privacy Policy and Notice of Changes
Use of an HMG Platform that incorporates this Privacy Policy confirms your agreement and consent to the terms of this Privacy Policy (the “Policy”). If you do not agree to these terms and conditions, do not use any of the HMG Platforms that incorporate this Policy.[CH4]
This Policy may be updated or changed in any manner at any time at Hope Media’s sole discretion. Updates to this Policy are effective when posted. It is your obligation, and you are expected to frequently check this page for any changes.
Your continued use of any of the HMG Platforms following the posting of any changes to these terms shall mean that you have accepted those changes with regard to your use of the HMG Platforms. HMG is particularly sensitive about guarding the privacy of children. HMG does not knowingly collect any more information than is needed from children under the age of 13 for use of our website. HMG does not knowingly collect personal information from children under the age of 13 without parental consent except as noted below.
PARENTS: HMG will seek your consent before collecting personal information from your child.
If you do not want your child’s personal information used by HMG or if you would like to find out what personal information HMG received from or about your child, please contact us by mail, email or phone at the address listed below.
CHILDREN: If you are under the age of 13, do not (1) provide any information on or through the HMG Platforms or any of their features, (2) register on any of the HMG Platforms, (3) make any purchases through any HMG Platform, (4) use the interactive or public comment features of this Website, or (5) provide any information about yourself to HMG or others through the HMG Platforms, including your name, address, telephone number, email address, or any screen name or user name you may use without your parents’ consent.

HMG collects information you provide directly, information collected automatically, information from cookies and similar technologies, information from third parties, and limited sensitive information (as explained below) when necessary or as determined by HMG for ministry, operational, or legal compliance purposes.
If you do not want personal information to be collected or used by Hope Media Group for purposes described in this policy, you may “opt out,” in the manner described below. However, opting out may prevent your participation in Hope Media activities for which personal information is needed.

HMG may receive personal information from payment processors, fundraising and donor-management providers, event or ticketing providers, social media and streaming platforms, advertising and analytics providers, data-quality providers, ministry or promotional partners, publicly available sources, and other people who interact with the HMG Platforms. HMG may combine this information with information collected through the HMG Platforms.
8. Combining Information and Creating Profiles
HMG operates as a family of brands and services under common management. HMG links information collected about you across its brands, websites, mobile applications, and services - and information received from donor-management, payment, email, contest, and analytics providers - using identifiers such as your name, email address, phone number, account identifiers, and device identifiers. HMG uses the combined information to recognize you across its services, maintain a unified record of your relationship with HMG, understand its audiences, personalize content and communications, measure and improve its programs and fundraising, and operate the HMG Platforms. Where the combined information includes sensitive information, HMG handles it as described in “Sensitive Personal Information.”
9. Sensitive Personal Information
Some information you choose to provide may be considered sensitive under applicable law. For example, prayer requests, stories, counseling or ministry communications may reveal religious or philosophical beliefs, physical or mental health information, family circumstances, financial account information, or other private matters. Account or device features may also involve precise location, information about a child, or authentication credentials.
HMG will process sensitive personal information only for the purposes disclosed when the information is collected, as reasonably necessary to provide the requested ministry or HMG Platform, or with consent when required by law. Please do not include sensitive personal information about another person unless you are authorized to provide it. You may withdraw consent by contacting HMG as described below, subject to applicable law and any continued lawful basis for processing.
In addition, HMG may use the information collected about you or that you provide to HMG in the following manner:
1. To present the HMG Platforms and their contents when they are accessed by you.
2. To provide you with information, products, or services that you request from HMG.
3. To fulfill any other purpose for which you provide the information.
4. To provide you with notices about your account or involvement with HMG or the HMG Platforms.
5. To carry out HMG’s legal obligations and enforce HMG’s rights arising from any contracts entered into between you and HMG, including for billing and collection.
6. To notify you about changes to the Website or any products or services HMG offers or provides through it.
7. To allow you to participate in interactive features on the Website.
8. To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
9. If HMG believes disclosure is necessary or appropriate to protect the rights, property, or safety of HMG, users of the HMG Platforms, or others.

10. Personalization and Profiling
HMG uses information about your activity - such as the content you play, read, or watch, and your engagement with the HMG Platforms and communications - to personalize your experience, recommend content, segment audiences for communications and fundraising, and for analytical purposes. HMG does not use this information to make decisions that produce legal or similarly significant effects about you without appropriate safeguards. Where applicable law provides a right to opt out of certain profiling, you may exercise it as described in “Your State Law Rights.”
11. Communications
Users may receive ministry updates, receipts, event notices, and operational communications. Marketing communications include opt-out options where required.
Push Notifications. If you grant permission for an HMG Platform to send push notifications to your mobile device, HMG and its service providers may send you ministry updates, content recommendations, fundraising appeals, prayer reminders, event notices, and other communications. To send push notifications, HMG collects and uses a device notification token assigned by your mobile operating system. You may withdraw permission and stop receiving push notifications at any time through your device's notification settings. Doing so does not affect any email or text-message subscriptions you have enrolled in separately.
12. Prayer Requests
Prayer requests may be shared with authorized ministry personnel and handled with care. Personally identifiable prayer requests are not publicly disclosed without appropriate consent.
13. Donor Information
Donor information is used to process gifts, issue receipts, maintain donor records, and comply with nonprofit requirements. Payment information is handled through HMG’s authorized processors.
14. Online Purchases
Billing, shipping, and transaction information is used to fulfill purchases and provide support.
15. Artificial Intelligence
Artificial intelligence may assist with search, chat, translation, accessibility, moderation, and recommendations on or in connection with the HMG Platforms. Artificial-intelligence output is not and should not be considered professional advice.
In addition, any data or personal information may be provided to Hope Media’s third-party service providers as necessary to provide the products or services that you request or to support the HMG Platforms that you access, including HMG’s own servers and hosting, payment, analytics, email, and other vendors HMG engages to operate the HMG Platforms.
Hope Media Group’s third-party service providers may have separate and independent privacy policies that are not controlled in any way by HMG. HMG welcomes any feedback about any third-party websites or databases that may be accessible through any HMG Platform.
16. Cookies and Similar Technologies
HMG uses essential, functional, analytics, and marketing cookies. Users may manage preferences where required by law[CH9] .
Some HMG Platforms also use product-analytics and session-replay (interaction-recording) tools, such as Microsoft Clarity, that capture how you interact with a page or screen - including clicks, taps, scrolling, navigation, and, on some screens, information you enter into a form. HMG uses this information to diagnose technical problems, improve usability, and understand how the HMG Platforms are used.[CH10]
17. Content You Watch and Listen To
HMG collects information about the audio, podcasts, and video content you access through the HMG Platforms, including titles and identifiers of the content and the date, time, and duration of use, associated with your account or device. HMG uses this information to operate and personalize the HMG Platforms and to measure engagement. HMG may share information about video content you watch with service providers that help operate and analyze the HMG Platforms; where required by law, HMG will obtain your consent before doing so.[CH11]

Analytics help improve ministry effectiveness, service quality, performance, and engagement.
19. How We Share Information
Information may be shared with service providers, ministry partners, or when required by law. HMG does not sell personal information for monetary consideration.[CH12]
20. Security of Your Personal Information
HMG implements a variety of security measures to maintain the safety of your personal information and to protect it from loss or unauthorized access. Your account information is stored within HMG’s database behind security devices and controls. Access to your information is limited to authorized personnel and service providers who provide the products and services you have requested or are entitled to receive. You have access to your account through the applicable HMG Platforms and access features that require your user identification and password to login. You are responsible for maintaining a secure password and for keeping it confidential. Online transaction processing containing credit card information is transmitted using security software and services engaged by HMG. The data is encrypted and sent to HMG’s payment gateway provider. The data can only be accessed by authorized personnel.
However, no security system is impenetrable. HMG cannot and does not guarantee the security of the Hope Media database or HMG Platforms, and HMG cannot and does not guarantee that the information you supply will not be intercepted while being transmitted by you. The transmission of information via the internet is not completely secure. Any transmission of personal information is at your own risk.
HMG DISCLAIMS ANY AND ALL LIABILITY FOR ANY CIRCUMVENTION OF ANY PRIVACY SETTINGS OR SECURITY MEASURES CONTAINED ON THE HMG PLATFORMS BY ANYONE WHO IS NOT UNDER THE AUTHORITY, DIRECTION, OR CONTROL OF HMG.
21. Data Retention
Information is retained as HMG deems necessary for ministry, operational, legal, and regulatory purposes. HMG will securely delete or anonymize information when and where appropriate or when required by applicable law.
22. Contacting HMG, Opt-Out, and Removing Your Name From Mailing Lists
HMG endeavors to employ a “no spam” policy. If you sign up for an email or newsletter, HMG’s expectation and operational prerogatives are that you will only receive that email or newsletter. If you no longer want to receive emails or newsletters, please send us an email at webmaster@hopemediagroup.com with the subject “REMOVE FROM MAILING LIST.” An opt-out election may take a reasonable amount of time to activate and make effective. If you have questions or comments about this Privacy Policy or its implementation to a particular HMG Platform, or if you request HMG to verify the accuracy of records containing your personal information, please contact Hope Media Group. HMG will make every reasonable effort to address your request or concern.
23. SMS Communications
Subscribers may receive recurring ministry text messages. Participation is voluntary, and opt-out instructions are provided where required.
24. Social Media
Interactions with HMG on social media are governed by this Policy to the extent applicable and by the privacy policies and terms of the applicable social media platform.
25. Your State Law Rights
State consumer privacy laws may provide their residents with additional rights regarding use of personal information. Certain states provide (now or in the future) their state residents with certain rights, including rights relating to:
1. Confirming whether a website operator processes personal information.
2. Access to and deletion of certain personal information.
3. Correct inaccuracies in personal information, taking into account the information’s nature processing purpose.
4. Data portability.
5. Opt-out of personal data processing for targeted advertising, sales, or profiling in furtherance of decisions that produce legal or similarly significant effects.
6. Either limit (opt-out of) or require consent to process sensitive personal data.
26. Do Not Track
HMG does not currently respond differently to browser “Do Not Track” signals due to the lack of a universal standard.[DA13] [CH14]

28. Intellectual Property
All content included on or within the HMG Platforms, including, without limitation, text, photographs, images, graphics, illustrations, music, audio clips, video clips, designs, logos, trademarks, data compilations, software, and other materials contained in the HMG Platforms and/or the selection or arrangement of any of the foregoing, is the sole and exclusive property of Hope Media Group and/or its licensors and is protected by applicable law, including copyright and trademark laws. Unauthorized use of such content is strictly prohibited.
Hope Media Group’s logos, brand identifiers, service marks, and trade dress may not be used by any other party without prior written authorization by HMG.

29. Transmission of Information to Other Countries
If you are located outside of the United States, please be aware that your information may be processed in the United States, where privacy laws may be less stringent than the laws in your country. By submitting your personal information to HMG, you agree to the transfer, storage and processing of your information in a country other than your country of residence including, but not necessarily limited to, the United States.

HMG also wants to make sure your personal data is accurate and up-to-date. Accordingly, you have a right to rectify or supplement your personal data. Under certain circumstances, you may also have a right to erase, restrict the processing of, transmit, or object to the processing of your personal data. If you would like to access, rectify, erase, restrict, transfer, or object to the processing of your personal data, please contact us as directed below.
Please note that in some circumstances, HMG may not be able to fully comply with your requests, or HMG may ask you to provide additional information in connection with your request, if needed to verify your identity or the nature of your request.
HMG may process your data based upon your consent, when it is necessary for services you request, when it is necessary for compliance with a legal obligation, or for any other lawful basis of processing. For all personal data collected and processed based upon your consent, you have a right to withdraw your consent at any time.

33. Changes to Privacy Policy
It is HMG’s practice to post on this page any changes made to this privacy policy. If HMG makes material changes to how HMG treats users’ personal information, HMG may notify you by email, if you specified an email address in your account. The date the privacy policy was last revised is identified at the top of the Website page. 34. Dispute Resolution
Any dispute arising from or related to this Privacy Policy and which the parties cannot resolve by negotiation shall be submitted to mediation and, if necessary, binding arbitration under the Rules of Procedure for Christian Conciliation of the Institute for Christian Conciliation, a division of Peacemaker® Ministries (complete text of the Rules is available at https://www.iccpeace.com/rules/) or any comparable entity agreed upon in writing by the parties.
The mediation and any arbitration shall be conducted exclusively by remote, electronic video means, unless the parties agree otherwise in writing. Any in-person mediation or arbitration shall take place exclusively in Montgomery County, Texas. Any arbitration award issued by the arbitrator shall be final, binding, and enforceable in any court of competent jurisdiction. The parties agree that any arbitration award will be enforceable in state or federal court otherwise having jurisdiction.
The parties to the mediation and any arbitration shall share equally in the fees of the mediator and arbiter, and the party that initiates a mediation or arbitration shall be solely responsible for the paying the initiation fees. Each party shall assume its own costs incurred in regard to the mediation and any arbitration. However, the prevailing party in any arbitration or court proceeding will be entitled to an award of its reasonable costs and attorney fees incurred as determined by the applicable arbiter or court of competent jurisdiction, together with such other relief as may be awarded in accordance with law and this Policy.
