Terms of Use
1. Hope Media Group and Its Mission. Hope Media Group (referred to at times below as “Hope Media” or “HMG”) owns and/or operates an array of online platforms, websites, radio stations, and brands that serve to connect people more deeply to God. Hope Media Group is a Texas nonprofit corporation organized and operated as a public charity organization described in Title 26, Section 501(c)(3) of the Internal Revenue Code.
2. Ministry Relationship Disclaimer. Hope Media Group is a nonprofit Christian ministry dedicated to communicating the hope of Jesus through media, technology, events, and community engagement. Nothing in these Terms of Use creates a pastoral, counseling, medical, legal, or fiduciary relationship.
3. HMG Platforms. Hope Media Group’s stations, brands, and mobile applications include KSBJ, Vida Unida, NGEN Radio, HOPE ON DEMAND, Special Events, [Between] Music and AMEN: The Prayer App [DA1] and all other HMG Platforms that incorporate these Terms of Use. As used herein, the term “HMG Platforms” or “HMG Platform” refers collectively or singularly, as applicable, to Hope Media Group’s websites, mobile applications, and online platforms that incorporate these Terms of Use. In addition, these Terms of Use incorporate by reference and are designed to work with HMG’s Privacy Policy and Gift Acceptance Policy. [DA2]
4. Expanded Scope. These Terms of Use apply to all current and future HMG ministries and digital properties that link to or incorporate them, including Hope Media Group, KSBJ, WayFM, Vida Unida, NGEN Radio, Worship 24/7, Hope Nation, Hope Events, God Listens, WAYLOUD, Way New, Way Back, Gospel 24/7, [Between] Music, online stores, streaming services, podcasts, mobile applications, donor portals, volunteer portals, and future HMG-operated properties.
5. User Commitment to Terms of Use: Hope Media Group operates the HMG Platforms for the personal enjoyment of users. Your use of any of the HMG Platforms that incorporate these Terms of Use constitutes your agreement to and acceptance of these Terms of Use, and you agree to comply with these Terms of Use and Hope Media Group’s Privacy Policy and Gift Acceptance Policy[DA3] , as applicable to your interaction with Hope Media Group and use of the HMG Platforms. If you do not agree to these Terms of Use, do not use any of the HMG Platforms that incorporate these Terms of Use.
6. Eligibility. Users must be legally able to enter into these Terms of Use and must provide accurate information. Minors may use the HMG Platforms only with appropriate parental or guardian involvement where required.
7. User Accounts. Users are responsible for maintaining the security of their accounts, credentials, and devices and for notifying HMG of unauthorized access.
8. Updates to Terms of Use. Hope Media Group may modify these Terms of Use at any time. Your use of the HMG Platform that incorporates these Terms of Use after any changes have been posted will constitute your agreement to the modified Terms of Use. You understand and agree that HMG may discontinue or change the HMG Platforms at any time, without notice. It is your obligation, and you are expected to check these Terms of Use frequently to determine whether any changes have been made. You also understand and agree that HMG may discontinue or restrict your use of any HMG Platforms for any reason without notice and without any liability to you. In addition, when using any of the HMG Platforms, you are subject to any posted guidelines or rules specific to the particular HMG Platform, which may be posted from time to time on the applicable HMG Platform and which are hereby incorporated by reference into these Terms of Use.
9. Service Availability. The HMG Platforms are provided as available and as is and may change without notice.
10. Suspension and Termination. HMG may suspend or terminate access for any reason, including violations of these Terms of Use.
11. Limitation of Use of Content. All content included on or within the HMG Platforms, including, without limitation, text, photographs, images, graphics, illustrations, music, audio clips, video clips, designs, logos, trademarks, data compilations, software, and other materials contained in the HMG Platforms and/or the selection or arrangement of any of the foregoing (collectively, the “HMG Content”), is the sole and exclusive property of Hope Media Group and/or its licensors from whom HMG has authorization of use and is protected by applicable law, including copyright and trademark laws. Unauthorized use of HMG content is strictly prohibited. Hope Media Group’s logos, brand identifiers, service marks, and trade dress may not be used by any other party without prior written authorization by HMG, which permission HMG may grant or refuse in HMG’s sole discretion. All rights are reserved.
12. Restrictions on Use of HMG Marks. Hope Media Group’s registered trademarks, including, without limitation, KSBJ™, GOD LISTENS.®, NGEN®, LIGHT FORCE™, TICKET SERVANT®, DIOS ESCUCHA®, THE VOICE OF HOPE CONNECTING PEOPLE TO GOD™, [DA4] as well as Hope Media Group’s service marks, logos and trade names (collectively, the “HMG Marks”) used on or in any of the HMG Platforms are the exclusive property of HMG or is licensors from whom HMG has permission of use. You agree not to display or use any of the HMG Marks in any manner without HMG’s prior written consent, which consent HMG may grant or refuse in HMG’s sole discretion. HMG reserves the right to seek an injunction against any user for infringement of HMG Marks, copyrighted materials and other violations of these Terms of Use.
13. Usage Policy. You are not permitted to copy, reproduce, distribute, publish, enter into a database, display, perform, modify, create derivative works, transmit, or in any way use any HMG Content or HMG Marks, except as follows: a) you may make one machine readable copy and one print copy of occasional items of personal interest, solely for personal, noncommercial use; and b) you may post a text-only hyperlink to an article or other item from an HMG website; however, HMG reserves the right to revoke such permission for links at any time. Any reproduction, printing, or other use of any HMG Content for any other purposes is strictly prohibited without the advance written permission of HMG, which permission HMG may grant or refuse in HMG’s sole discretion.
14. Acceptable Use. Users must comply with applicable law and may not misuse the HMG Platforms, infringe rights, distribute malware, scrape content without authorization, or upload unlawful or abusive material.
15. Privacy. You agree to respect and to not violate the privacy or other personal rights of other users and to not use the personal information of any other user for any commercial, promotional or other purpose.
16. Donations. Any user may become a donor (generally referred to herein as “Donor”) by pledging a donation to Hope Media Group through the donation tools on the HMG Platforms. You acknowledge and agree that you are under no obligation to become a Donor or to pledge a donation and that you will be solely responsible for any decision to become a Donor. You understand that your contribution, if any, will be made to Hope Media Group and that HMG has exclusive legal control over all donations. You agree that the provisions of the Gift Acceptance Policy [DA5] also apply to any donations made to HMG and that when you make a donation, you agree to the terms and conditions of all policies. You represent and agree that all payment information you provide to HMG or HMG’s third-party service providers will be true, accurate, current, and complete and that you will update such payment information as necessary to maintain such information as true, accurate, current and complete. In the event that your payment cannot be processed due to inaccurate payment information, insufficient funds, or any other reason, you agree to immediately provide HMG with alternative payment information to fulfill your donation pledge. Donations are voluntary and generally non-refundable except where required by law or approved by HMG. Authorized recurring donations through designated payment methods continue until cancelled by the Donor.
17. Purchases and Online Store. Separate return, shipping, subscription, or event policies may apply to purchases made through an HMG Platform.
18. Events. Registration for HMG events may include consent to photography, image release, and recording for ministry purposes.
19. Third-Party Links and Risks Assumed. The HMG Platforms may contain links to or other means to access other internet sites or third-party platforms (generally, the “Third-Party Platforms”). The ability to access Third-Party Platforms is not an HMG endorsement of those Third-Party Platforms and/or any products or services referenced therein. None of the information in Third-Party Platforms has been endorsed or approved by HMG, and HMG has no control or oversight of Third-Party Platforms. As such, you agree that your access or use of any third-party platform accessible through any hmg platform is at your sole risk and that HMG shall have no liability whatsoever for any injury or damage you may sustained by your access or use of any third-party platform, including if caused by the negligence (sole or contributory) of hmg, ITS EMPLOYEES, CONTRACTORS, OR AGENTS.
20. Third-Party and Open-Source Components. The HMG Platforms, including HMG websites and mobile applications, may include software components licensed from third parties, including open-source software. Those components are provided under their own license terms. To the extent a third-party or open-source license conflicts with these Terms of Use, that license controls for the component it covers. Nothing in these Terms of Use limits or grants rights that supersede an applicable open-source license. Applicable notices, attributions, license texts, and any source code required to be made available may be provided in the applicable platform’s about or legal screen or upon request using the Contact Us information below.
21. Third-Party Services. External services remain governed by their own terms and privacy policies.
22. Posting And Comments. User or third-party submissions or postings are the views of the author or poster. They do not necessarily reflect the views of HMG. HMG reserves the right to edit or delete for any reason, any postings or material submitted to HMG or posted on any HMG Platform. HMG has the sole discretion over whether to publish, edit or delete any material submitted to any HMG Platform, including, without limitation, in HMG’s “My Story,” “Need Prayer”, forums, calendars, blogs, or other sections of the HMG Platforms.
23. Prayer Requests. Prayer requests may be shared internally with authorized ministry personnel. Personally identifying information will not be publicly disclosed without appropriate consent.
24. License to User Content Granted to HMG. By submitting any postings, comments, content, or other messages or materials (collectively referred to as “User Content”) to HMG or through any of the HMG Platforms, you grant HMG an irrevocable, perpetual, worldwide, royalty-free, and sub-licensable license to use, republish, make derivative works from, and to otherwise exploit all User Content and other copyrightable works submitted by you to HMG or through any of the HMG Platforms. Without limiting the foregoing, you agree that HMG has the right to publish the User Content in any media now known or hereafter developed, and to use, adapt, recast, distribute, display, perform, or transmit all such User Content in any way, as HMG may determine in its sole discretion. By submitting your name or other identifying data with a posting or other submission of User Content, you grant HMG the right to publish that data and to use that data for promotional or any other purpose.
25. User Content Ownership and Supplemental License. Users retain ownership of submitted User Content while granting HMG a perpetual, irrevocable, worldwide, royalty-free, fully paid, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, and otherwise exploit that User Content for ministry, operational, educational, promotional, archival, and administrative purposes, including to develop, improve, market, and support the HMG Platforms, without any obligation, attribution, or compensation to the user.
26. Account Termination and Deletion. You may stop using the HMG Platforms at any time. If you have an account, you may delete it using account tools available in the applicable HMG Platform, including within HMG mobile applications, or by contacting HMG using the Contact Us information below. HMG will act on a verified deletion request within a reasonable time and, where practicable, confirm completion. Deleting an account cancels any recurring donation scheduled through that account on a going-forward basis but does not reverse completed transactions. When an account is deleted or terminated, the right to access the HMG Platforms through that account ends, and HMG will delete or de-identify associated personal information as described in the Privacy Policy. HMG may retain information as reasonably necessary for legal, tax, accounting, donation-recordkeeping, audit, dispute-resolution, enforcement, and security purposes. HMG may also retain User Content shared publicly or incorporated into ministry or broadcast content, in de-identified form where practicable, and content may persist in routine backups for a limited retention period. HMG does not guarantee that it will store, retain, or continue to make available any User Content, and users should keep their own copies of important material.
27. Survival. The provisions concerning HMG Content and intellectual property, User Content, feedback, warranty disclaimers, limitations of liability, indemnification, dispute resolution, governing law and forum, and miscellaneous terms survive termination of these Terms of Use or deletion of an account.
28. Feedback. You may send comments, suggestions, ideas, bug reports, feature requests, ratings, reviews, or other feedback about the HMG Platforms (collectively, “Feedback”). Feedback is not confidential, and HMG is not required to treat it as confidential or act on it. You grant HMG a perpetual, irrevocable, worldwide, royalty-free, fully paid, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, and otherwise exploit Feedback for any purpose, including developing, improving, marketing, and supporting the HMG Platforms, without obligation, attribution, or compensation. You must not provide Feedback that you do not have the right to share or that contains confidential or proprietary information.
29. Copyright Infringement Notice. HMG respects copyright and other intellectual property rights and expects all HMG Platform users to do the same. If you believe in good faith that any content on any HMG Platform infringes your copyright, you may notify Hope Media Group and request corrective action; however, HMG does not guarantee that any action will be taken as a result of your correspondence, or that action will be taken in any time period suggested by you. Notices should be sent to HMG through the “Contact Us” webpage located on Hope Media Group’s home webpage or to the address below.
30. Confidentiality and Proprietary Terms. You agree to not submit to HMG or through any HMG Platform any confidential, proprietary, or copyrighted material without authorization of the owner. By submitting any User Content to any HMG Platform, you represent and warrant to HMG that you are the original author of such material or have the necessary permission to submit such User Content for use in accordance with these Terms of Use.
31. No Destructive Software and User Content Rules. By submitting any User Content to HMG or through any HMG Platform, you represent and warrant that such User Content, including material, links and/or attachments, are free from any type of destructive software, including but not limited to viruses, worms, Trojan horses, and other forms of malware. The posting of any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation is prohibited. Submission of any material that is obscene, pornographic, defamatory, incites violence, is harassing, that provides non-public personally identifying information about a person or persons, or that infringes any trademark, copyright, privacy right, or other legal right is prohibited.
32. Security. HMG maintains reasonable safeguards but cannot and does not guarantee absolute security.
33. ASSUMPTION OF RISK AND RELEASE. Your use of any of the hmg platforms, and any reliance on any material published or transmitted by the hmg platforms, is at your own risk. You agree that you hereby release HMG and its officers, directors, employees, agents, affiliates, advertisers, supporters, and authors from any and all losses, damages, and/or liability or obligations of any kind (COLLECTIVELY, “LOSSES”) arising from your access or use of any of the hmg platforms, THE user CONTENT that you provide ON the hmg platforms or any public forum or other area of the hmg platforms, including if such losses are caused by the negligence (sole or contributory) of hmg, ITS EMPLOYEES, CONTRACTORS, OR AGENTS.
34. INDEMNITY. You agree TO indemnify and hold harmless, HMG and its officers, directors, employees, agents, affiliates, advertisers, supporters, and authors from any and all losses arising from your access or use of any of the hmg platforms, THE user CONTENT that you provide ON the hmg platforms or any public forum or other area of the hmg platforms, including if such losses are caused by the negligence (sole or contributory) of hmg, ITS EMPLOYEES, CONTRACTORS, OR AGENTS.
35. Disclaimer for User Messaging. HMG disclaims any responsibility for any messages or postings submitted to any HMG Platform that permits user posting of User Content, including, without limitation, messages posted to HMG’s “My Story” and “Need Prayer” webpages, discussion forum, or anywhere on the HMG Platforms. HMG reserves the right to review or edit such messages, and to restrict or deny access to any HMG Platform’s public discussion sections or other part of the HMG Platforms. HMG does not knowingly collect or seek any data or submissions from people who are under the age of 13. HMG provides the “Need Prayer” webpage and other discussion forums solely as a public service. HMG disclaims all liability for information posted to such webpageS OR HMG PLATFORMS. If you have needs requiring a counselor, doctor, or other professional, YOU ARE ENCOURAGED TO seek INDEPENDENT professional assistance. HMG does not and cannot provide medical, legal, or financial advice or licensed professional counseling.
36. Artificial Intelligence Features. Artificial intelligence features may be provided to assist users and do not constitute professional, legal, medical, financial, or pastoral advice. HMG may deploy artificial intelligence and other emerging technologies in connection with the HMG Platforms.
37. Mobile Applications. Users agree to maintain secure devices and comply with applicable application and app-store requirements and terms of use or service.
38. SMS Messaging. Participation in HMG messaging programs is voluntary. Message frequency varies, message and data rates may apply, and opt-out instructions are provided.
39. Electronic Communications. Users consent to receive electronic communications relating to the HMG Platforms. Opt-out or unsubscribe instructions will be provided when required by applicable law.
40. Access Outside of the United States. HMG makes no representation that materials or content on the HMG Platforms are appropriate or available for use in locations outside of the United States of America or its territories, and you and all other users are strictly prohibited from accessing any of the HMG Platforms in locations or territories where the HMG Platform content is illegal. If you choose to access any of the content on any of the HMG Platforms from locations outside of the United States of America or its territories, you do so at your own risk and initiative, and you are solely responsible for compliance with local laws applicable to your use or access.
41. International Users. International users consent to processing in applicable jurisdictions, subject to the Privacy Policy and applicable law.
42. Compliance with Laws. Users must comply with all applicable laws when accessing or using the HMG Platforms.
43. Export Compliance. Users agree to comply with applicable export-control laws.
44. Accessibility Commitment. HMG endeavors to align its digital properties with recognized accessibility standards and to comply with applicable legal requirements regarding user accessibility.
45. Disclaimer of Warranties. HMG publishes articles and other content solely for entertainment and informational purposes (generally referred to herein as “Informational Content”). Informational Content may not be accurate, complete, or up to date. The HMG Platforms may include facts, views, opinions and recommendations of individuals and organizations deemed of interest, but HMG does not necessarily endorse these views, opinions and recommendations. THE HMG PLATFORMS AND ALL CONTENT CONTAINED THEREIN OR ACCESSIBLE BY A USER IS PROVIDED “AS IS.” HMG SPECIFICALLY DISCLAIMS ANY REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, AS TO ANY AND ALL OF THE HMG PLATFORMS, INCLUDING HMG’S WEBSITES, MOBILE APPLICATIONS, AND OTHER HMG PLATFORMS AS DEFINED, AND THEIR CONTENT, INCLUDING, WITHOUT LIMITATION, CONTENT GENERATED BY ARTIFICIAL INTELLEGENCE OR THIRD PARTIES, ANY REPRESENTATIONS OR WARRANTIES OF ACCURACY, COMPLETENESS, TIMELINESS, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. HMG MAKES NO GUARANTEES WHATSOEVER AS TO THE CORRECTNESS, ACCURACY, AND/OR RELIABILITY OF THE HMG PLATFORMS, NOR OF ANY REVIEW, ADVICE, OPINION, STATEMENT, OR OTHER INFORMATION DISPLAYED OR PROVIDED THROUGH THE HMG PLATFORMS. YOU ACKNOWLEDGE THAT ANY RELIANCE UPON ANY SUCH REVIEW, OPINION, ADVICE, STATEMENT, MEMORANDUM, OR INFORMATION SHALL BE AT YOUR SOLE RISK.
46. Limitation of Liability HMG DISCLAIMS ALL LIABILITY AND RESPONSIBILITY FOR ANY ERRORS, OMISSIONS, BUGS, VIRUSES, OR OTHER PROBLEMS IN THE HMG PLATFORMS AND FOR ANY DAMAGES CAUSED THEREBY, including if caused by the negligence (sole or contributory) of hmg, ITS EMPLOYEES, CONTRACTORS, OR AGENTS.
47. No Obligation to Take Action and No User Reliance. HMG HAS NO OBLIGATION TO YOU TO TAKE ANY ACTION BASED ON ANY INFORMATION YOU POST ON ANY OF THE HMG PLATFORMS. HMG reserves the right to restrict or limit access to the hmg platforms at any time, with or without notice. in addition, YOU AGREE THAT HMG SHALL HAVE NO LIABILITY TO YOU FOR ANY LOSS OR INJURY CAUSED IN WHOLE OR PART BY (1) the negligence (sole or contributory) of hmg, ITS EMPLOYEES, CONTRACTORS, OR AGENTS OR (2) YOUR USE OR ACCESS OF ANY OF THE HMG PLATFORMS, INCLUDING ANY ACTION OR INACTION BASED ON MATERIALS YOU POST, UPLOAD OR DOWNLOAD ON OR FROM THE HMG PLATFORMS, OR ANY DONATION YOU MAKE VIA THE HMG PLATFORMS OR CONTINGENCIES IN PROCURING, COMPILING, INTERPRETING, REPORTING OR DELIVERING HMG AND ITS CONTENT. IN NO EVENT WILL HMG BE LIABLE TO YOU FOR ANY DECISION MADE OR ACTION TAKEN BY YOU IN RELIANCE ON HMG CONTENT, including if caused by the negligence (sole or contributory) of hmg, ITS EMPLOYEES, CONTRACTORS, OR AGENTS.
48. No Consequential or Indirect Damages. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HMG SHALL NOT BE LIABLE TO YOU FOR ANY DAMAGES (INCLUDING, WITHOUT LIMITATION, CONSEQUENTIAL, SPECIAL, INCIDENTAL, LOSS PROFITS, INDIRECT, PUNITIVE OR SIMILAR DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AS A RESULT OF YOUR USE OR ACCESS OF ANY OF THE HMG PLATFORMS, including if caused by the negligence (sole or contributory) of hmg, ITS EMPLOYEES, CONTRACTORS, OR AGENTS.
49. Force Majeure. HMG is not liable for events beyond its reasonable control.
50. Dispute Resolution. Any dispute arising from or related to these Terms of Use and which the parties cannot resolve by negotiation shall be submitted to mediation and, if necessary, binding arbitration under the Rules of Procedure for Christian Conciliation of the Institute for Christian Conciliation, a division of Peacemaker® Ministries (complete text of the Rules is available at https://www.iccpeace.com/rules/) or any comparable entity agreed upon in writing by the parties. The mediation and any arbitration shall be conducted exclusively by remote, electronic video means, unless the parties agree otherwise in writing. Any in-person mediation or arbitration shall take place exclusively in Montgomery County, Texas. Any arbitration award issued by the arbitrator shall be final, binding, and enforceable in any court of competent jurisdiction. The parties agree that any arbitration award will be enforceable in state or federal court otherwise having jurisdiction. The parties to the mediation and any arbitration shall share equally in the fees of the mediator and arbiter, and the party that initiates a mediation or arbitration shall be solely responsible for the paying the initiation fees. Each party shall assume its own costs incurred in regard to the mediation and any arbitration. However, the prevailing party in any arbitration or court proceeding will be entitled to an award of its reasonable costs and attorney fees incurred as determined by the applicable arbiter or court of competent jurisdiction, together with such other relief as may be awarded in accordance with law and these Terms of Use.
51. Time to Bring Claims. Any claim or cause of action you may have with respect to your use or access of any of the HMG Platforms must be commenced within one (1) year after the claim or cause of action arises; otherwise, the claim or cause of action shall be deemed forever waived and barred.
52. Governing Law and Forum. The HMG Platforms (excluding linked sites) are controlled by Hope Media Group from its offices within the United States of America. By accessing any of the HMG Platforms you agree that the laws of the State of Texas, without regard to conflicts of laws principles thereof, will apply to all matters relating to the use of the HMG Platforms. You agree and hereby submit to the exclusive personal jurisdiction and venue of the state and federal courts in the State of Texas, County of Montgomery with respect to such matters, and you hereby consent to extra-territorial service of process.
53. Assignment. Users may not assign these Terms of Use without HMG’s consent.
54. No Waiver. HMG’s failure to enforce a provision of these Terms of Use is not a waiver of that provision.
55. Entire Agreement. These Terms of Use constitutes the entire agreement between HMG and you with respect to your use or access of any of the HMG Platforms and supersedes and extinguishes any and all prior written or oral agreements between HMG and you with respect to this subject matter.
56. Severability. If for any reason a court, arbiter, or other tribunal of competent jurisdiction finds any provision of these Terms of Use, or portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to effect the intent of the Terms of Use, and the remainder of these Terms of Use shall continue in full force and effect.
